It is known from the State Intellectual Property of the P.R.C (SIPO) that as more Chinese enterprises go global, China has carried out a lot of measures to provide convenience for overseas patent application and rights protection of Chinese enterprises. More and more Chinese enterprises focus on safeguarding their overseas rights through patent layout.

In the first half of 2017, the number of PCT (Patent Cooperation Treaty) international patent applications submitted by Chinese applicants through SIPO was 20,000, with a year-on-year growth of 15.3%. According to the Report on 2016 PCT International Patent Applications released by the World Intellectual Property Organization (WIPO), Zhongxing Telecommunication Equipment Corporation (ZTE) ranked the top with 4,123 PCT international patent applications. And Huawei Technologies Co. Ltd (Huawei) ranked the second, recording 3,692 PCT international patent applications.

Chen Hongbing, the director of WIPO Office in China, indicated that Chinese enterprises need to pay attention to the risks from two aspects when marching towards overseas markets. On one hand, they may infringe others’ rights unintentionally due to the incomprehension of overseas intellectual property conditions. On the other hand, they may suffer IPR infringement due to the lack of effective intellectual property layout abroad.

In order to effectively guarantee the overseas rights for Chinese enterprises, SIPO, focusing on the authorization and protection of patent rights abroad, carried out a lot of work including the following three aspects:

First, it signed “Patent Prosecution Highway” (PPH) agreements with patent examination agencies in 23 countries and areas successively. PPH cooperation network has taken shape.

Second, it set mutual fund of overseas intellectual property rights protection for Chinese enterprises, providing fund guarantee for these enterprises.

Third, it established professional overseas intellectual property information platform, offering reference of “Go Globally” strategy to these enterprises.
